國家發展改革委聯合住房城鄉建設部印發 《關于推進全過程工程咨詢服務發展的指導意見》
近日,國家發(fa)(fa)展(zhan)改革委(wei)、住(zhu)房(fang)城(cheng)鄉(xiang)建(jian)設(she)(she)部聯合印發(fa)(fa)《關于推進全過程(cheng)工(gong)程(cheng)咨詢服務發(fa)(fa)展(zhan)的(de)指(zhi)導意見(jian)》(發(fa)(fa)改投(tou)資規〔2019〕515號,以下簡稱《指(zhi)導意見(jian)》),在(zai)房(fang)屋建(jian)筑和(he)市(shi)政(zheng)基(ji)礎設(she)(she)施(shi)領域(yu)推進全過程(cheng)工(gong)程(cheng)咨詢服務發(fa)(fa)展(zhan),提升固定資產投(tou)資決(jue)策(ce)科(ke)學化水平,進一步完善工(gong)程(cheng)建(jian)設(she)(she)組織(zhi)模式,推動高質量發(fa)(fa)展(zhan)。
《指(zhi)導意見》指(zhi)出,改革(ge)開放以來,我國工程咨(zi)詢服(fu)(fu)務(wu)市場化(hua)、專業化(hua)快速發(fa)展,形成(cheng)了投(tou)(tou)資(zi)(zi)咨(zi)詢、招(zhao)標代理、勘(kan)察、設(she)(she)計、監理、造價、項(xiang)(xiang)目管理等(deng)咨(zi)詢服(fu)(fu)務(wu)業態。隨著我國固(gu)定資(zi)(zi)產(chan)投(tou)(tou)資(zi)(zi)項(xiang)(xiang)目建(jian)設(she)(she)水平(ping)逐步提高,為更(geng)好地實現投(tou)(tou)資(zi)(zi)建(jian)設(she)(she)意圖,投(tou)(tou)資(zi)(zi)者或建(jian)設(she)(she)單(dan)位在固(gu)定資(zi)(zi)產(chan)投(tou)(tou)資(zi)(zi)項(xiang)(xiang)目決(jue)策、工程建(jian)設(she)(she)、項(xiang)(xiang)目運營(ying)過程中(zhong),對(dui)綜合性、跨階段、一體化(hua)的咨(zi)詢服(fu)(fu)務(wu)需求(qiu)日益增強。這種需求(qiu)與現行制度造成(cheng)的單(dan)項(xiang)(xiang)服(fu)(fu)務(wu)供給模式之(zhi)間的矛盾日益突出。因此,有必要創新(xin)咨(zi)詢服(fu)(fu)務(wu)組織實施方式,大力發(fa)展以市場需求(qiu)為導向(xiang)、滿足委托方多樣化(hua)需求(qiu)的全過程工程咨(zi)詢服(fu)(fu)務(wu)模式。
《指導意(yi)見》從鼓勵發展多種形(xing)式(shi)全過程工程咨詢、重點培(pei)育全過程工程咨詢模式(shi)、優化市場環境(jing)、強化保障措施等(deng)方面提出一系列(lie)政(zheng)策措施。
一是明(ming)(ming)確(que)了培(pei)育(yu)發(fa)展(zhan)全(quan)過程(cheng)(cheng)工(gong)(gong)程(cheng)(cheng)咨(zi)詢(xun)(xun)的兩個著力(li)點(dian)。《指導意見》堅持市(shi)(shi)場(chang)培(pei)育(yu)和(he)(he)(he)政府引導相結合(he)的原則,鼓(gu)勵咨(zi)詢(xun)(xun)單位根(gen)據市(shi)(shi)場(chang)需求(qiu)(qiu),從(cong)投資(zi)決(jue)策(ce)、工(gong)(gong)程(cheng)(cheng)建(jian)設、運營等項目(mu)全(quan)生命周期角度,開展(zhan)跨階(jie)段咨(zi)詢(xun)(xun)服(fu)務組(zu)(zu)合(he)或同一階(jie)段內(nei)不同類型咨(zi)詢(xun)(xun)服(fu)務組(zu)(zu)合(he),發(fa)展(zhan)多種形式的全(quan)過程(cheng)(cheng)工(gong)(gong)程(cheng)(cheng)咨(zi)詢(xun)(xun)服(fu)務模式。同時,結合(he)投資(zi)高(gao)質(zhi)量發(fa)展(zhan)和(he)(he)(he)工(gong)(gong)程(cheng)(cheng)質(zhi)量提(ti)升需求(qiu)(qiu),立足關鍵環節,《指導意見》針對項目(mu)決(jue)策(ce)和(he)(he)(he)建(jian)設實施(shi)兩個階(jie)段,重(zhong)點(dian)培(pei)育(yu)發(fa)展(zhan)投資(zi)決(jue)策(ce)綜合(he)性咨(zi)詢(xun)(xun)和(he)(he)(he)工(gong)(gong)程(cheng)(cheng)建(jian)設全(quan)過程(cheng)(cheng)咨(zi)詢(xun)(xun),為推(tui)進(jin)全(quan)過程(cheng)(cheng)工(gong)(gong)程(cheng)(cheng)咨(zi)詢(xun)(xun)指明(ming)(ming)了發(fa)展(zhan)方(fang)向和(he)(he)(he)實施(shi)路徑。
二是明確了投(tou)資(zi)決(jue)策(ce)綜(zong)(zong)合(he)(he)性(xing)咨詢的內容和方式。《指導(dao)意見》要求投(tou)資(zi)決(jue)策(ce)綜(zong)(zong)合(he)(he)性(xing)咨詢要統(tong)籌考慮影(ying)響(xiang)項(xiang)目可行性(xing)的各種因素,將各專項(xiang)評價評估一并(bing)納入可行性(xing)研究統(tong)籌論證(zheng),提高決(jue)策(ce)科學化(hua)水平。投(tou)資(zi)決(jue)策(ce)綜(zong)(zong)合(he)(he)性(xing)咨詢服務可由(you)工程咨詢單(dan)位采取市場合(he)(he)作(zuo)、委托專業服務等方式牽(qian)頭提供,或(huo)由(you)其會同具備相應資(zi)格(ge)的服務機構聯合(he)(he)提供。《指導(dao)意見》鼓(gu)勵(li)納入有關行業自律管理體系的工程咨詢單(dan)位開(kai)展綜(zong)(zong)合(he)(he)性(xing)咨詢服務,鼓(gu)勵(li)咨詢工程師(投(tou)資(zi))作(zuo)為(wei)綜(zong)(zong)合(he)(he)性(xing)咨詢項(xiang)目負責(ze)人。
三是明確(que)了工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)建(jian)(jian)(jian)設全(quan)過程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)的內容和條件。《指(zhi)導(dao)意(yi)見(jian)》鼓勵實施工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)建(jian)(jian)(jian)設全(quan)過程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun),由咨(zi)(zi)(zi)詢(xun)單(dan)位提(ti)供招標代(dai)理(li)、勘(kan)察、設計(ji)、監(jian)理(li)、造價(jia)、項目管理(li)等全(quan)過程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)服(fu)務(wu)。《指(zhi)導(dao)意(yi)見(jian)》規(gui)(gui)定(ding),工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)建(jian)(jian)(jian)設全(quan)過程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)單(dan)位提(ti)供勘(kan)察、設計(ji)、監(jian)理(li)或(huo)造價(jia)咨(zi)(zi)(zi)詢(xun)服(fu)務(wu)時,應當(dang)具有與工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)規(gui)(gui)模及委(wei)托內容相適應的資質條件。這樣的企業(ye)資質要求(qiu)符(fu)合法律(lv)法規(gui)(gui)及相關政(zheng)策規(gui)(gui)定(ding)。《指(zhi)導(dao)意(yi)見(jian)》對(dui)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)建(jian)(jian)(jian)設全(quan)過程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)項目負責人(ren)的資格(ge)提(ti)出較高要求(qiu):應當(dang)取(qu)得工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)建(jian)(jian)(jian)設類注冊執業(ye)資格(ge)且具有工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)類、工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)經(jing)濟類高級(ji)職稱,并具有類似工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)經(jing)驗。對(dui)于(yu)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)建(jian)(jian)(jian)設全(quan)過程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)(zi)(zi)詢(xun)服(fu)務(wu)中承擔工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)(cheng)勘(kan)察、設計(ji)、監(jian)理(li)或(huo)造價(jia)咨(zi)(zi)(zi)詢(xun)業(ye)務(wu)的負責人(ren),應具有法律(lv)法規(gui)(gui)規(gui)(gui)定(ding)的相應執業(ye)資格(ge)。
四是明確了(le)全過(guo)程(cheng)工程(cheng)咨(zi)詢(xun)(xun)服務(wu)酬(chou)金計取(qu)(qu)方式。《指導意見》規定全過(guo)程(cheng)工程(cheng)咨(zi)詢(xun)(xun)服務(wu)酬(chou)金可(ke)在項目(mu)(mu)投(tou)(tou)(tou)資(zi)(zi)(zi)(zi)中(zhong)列支,也可(ke)根據所包含的專(zhuan)項服務(wu)(投(tou)(tou)(tou)資(zi)(zi)(zi)(zi)咨(zi)詢(xun)(xun)、招標代(dai)理、勘(kan)察(cha)、設(she)計、監理、項目(mu)(mu)管理等)在項目(mu)(mu)投(tou)(tou)(tou)資(zi)(zi)(zi)(zi)中(zhong)列支的費用進行支付。全過(guo)程(cheng)工程(cheng)咨(zi)詢(xun)(xun)服務(wu)酬(chou)金既(ji)可(ke)按各專(zhuan)項服務(wu)費用疊加(jia)后(hou)再增加(jia)相應(ying)統籌管理費用計取(qu)(qu),也可(ke)按人工成(cheng)本加(jia)酬(chou)金方式計取(qu)(qu)。鼓勵投(tou)(tou)(tou)資(zi)(zi)(zi)(zi)者或(huo)建(jian)設(she)單位根據咨(zi)詢(xun)(xun)服務(wu)節約的投(tou)(tou)(tou)資(zi)(zi)(zi)(zi)額對咨(zi)詢(xun)(xun)單位予以獎勵。
此外,《指導意見(jian)》明確(que)了推進(jin)全過程工程咨(zi)詢(xun)服務(wu)發展的(de)部門職責分工,以及(ji)加強政(zheng)府監管和行業自律(lv)的(de)措施,確(que)保全過程工程咨(zi)詢(xun)服務(wu)持續(xu)健康發展。
